1. About these Terms

These Terms govern your use of sayartstudio.in (the “Site”) and any purchase from Say Art Studio (“we”, “us”), a seller of handmade resin art, pooja thalis, candles and clay diyas. By registering, placing an order or using the Site you agree to these Terms, our Privacy Policy and our Refund, Cancellation & Shipping Policy. If you do not agree, please do not use the Site.

2. Account and Registration

  • You must be at least 18 years old, or use the Site under a parent or guardian’s supervision, and be able to enter a binding contract under Indian law.
  • You must provide true, current and complete details (name, mobile, email, address) and keep them updated.
  • You are responsible for keeping your password and OTP confidential and for all activity under your account. Tell us immediately of any unauthorised use.
  • At registration we record your acceptance of these Terms, including the date and time, IP address, browser details and the version of the Terms accepted. We keep this record as evidence of your agreement.
  • We may suspend or close an account for false information, misuse, fraud or breach of these Terms. You may request closure of your account at any time, subject to legal retention (see Privacy Policy).

3. Products and Accuracy of Information

Our products are handmade. Slight variations in colour, size, shape, finish, bubbles or texture are natural and are not defects. Photographs and screen colours are indicative. We try to keep descriptions, prices and availability accurate, but errors may occur. We may correct errors, and cancel an order affected by a clear pricing or stock error, in which case any amount paid will be refunded in full.

4. Prices and Payment

  • All prices are in Indian Rupees (INR).
  • Delivery is free within India unless stated otherwise on the Site.
  • The payment options available to you are shown at checkout (for example UPI QR code). For UPI payments you must provide the UTR/transaction reference or a payment screenshot.
  • Your order is confirmed only after we manually verify your payment. Until then it is a request and not a binding contract. Verification may take some time; we may contact you if details do not match.

5. Orders, Cancellation and Address Changes

You may cancel an order or edit the delivery address only until payment is confirmed by us. After confirmation, orders are processed and these changes may not be possible. See the Refund, Cancellation & Shipping Policy for details.

6. Shipping and Delivery

We aim to deliver within 7-10 working days through third-party courier partners. This is an estimate, not a guarantee; delays caused by couriers, weather, festivals or other events beyond our control are not our breach. You must give a complete and correct address and be reachable by phone for delivery.

7. Returns and Refunds

Return policy: Non-returnable. Products are not returnable, exchangeable or refundable, except for a claim for an item damaged during transit, as set out below.

  • How to report damage: email sales@sayartstudio.in or WhatsApp +91-7982967825 within 48 hours of delivery, with your order number, clear photos of the damaged item and packaging, and the unboxing video. Claims reported after 48 hours, or without photos/unboxing video, cannot be accepted.
  • Courier investigation: we raise the damage claim with our courier partner. A refund is approved only if the item is confirmed damaged in transit and only after the courier partner’s investigation is complete.
  • Timeline: once approved, the refund is made to the original payment source (UPI account) within a maximum of 15 working days from the date you reported the damage.
  • No other refunds: no refund is given for change of mind, wrong selection, delay by the courier, or natural variations of handmade items (colour, size, shape, finish, bubbles or texture).

8. Consent to be Contacted

You agree that we may contact you by phone call, WhatsApp and email at the details you provide for purposes related to your account and orders (OTP, order confirmation, payment verification, shipping, delivery, support). Promotional messages will be sent only if you separately agree, and you can opt out at any time.

8A. Optional Promotional Emails

At registration or checkout you may tick a separate, optional box to receive news, offers and new product updates from Say Art Studio by email. This box is not ticked by default, and not ticking it does not affect your registration or order. We record your choice with the date and time, IP address and the version of these Terms. You can withdraw this consent at any time, free of charge, by clicking the unsubscribe link in any promotional email, changing your email preferences in My Account, or writing to sales@sayartstudio.in. Order, payment, shipping and account emails are not promotional and will continue to be sent.

9. Intellectual Property

All designs, artwork, product photographs, text, logos and content on the Site belong to Say Art Studio or its licensors and are protected by Indian law, including the Copyright Act, 1957. You may not copy, reproduce, reproduce for sale, modify or commercially use them without our written permission. Personal, non-commercial sharing of a link to the Site is permitted.

10. Acceptable Use

You must not misuse the Site, submit false payment proof, attempt unauthorised access, interfere with its operation, or use it for any unlawful purpose.

11. Limitation of Liability

To the maximum extent permitted by law, the Site and products are provided on an “as is” basis for the descriptions given, and we are not liable for indirect, incidental or consequential loss, or for delays or loss caused by courier partners or events beyond our reasonable control. Our total liability for any claim relating to an order shall not exceed the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded under law, or limits your rights under the Consumer Protection Act, 2019.

12. Indemnity

You agree to indemnify Say Art Studio against losses, claims and reasonable costs arising from your breach of these Terms, your submission of false information or payment proof, or your unlawful use of the Site.

13. Electronic Records and Consent

These Terms, your acceptance, orders, invoices and communications are electronic records under the Information Technology Act, 2000 and rules made under it. No physical or digital signature is required. You consent to transact and receive notices electronically, and agree that our electronic records of your acceptance and orders are valid evidence.

14. Grievance Redressal (Consumer Protection (E-Commerce) Rules, 2020)

15. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to any rights you have under consumer law, the courts at Ghaziabad, Uttar Pradesh shall have exclusive jurisdiction.

16. Changes and General

Say Art Studio may modify these Terms and its policies at any time at its discretion. Changes are effective when posted on the Site, and continued use of the Site means acceptance of the changes. If any provision is unenforceable, the rest remains valid. These Terms with the linked policies are the entire agreement between you and us.
